    Men At Work in court battle over royalties

    I just read today that Men At work, lead by Colin Hay are in court, because someone believes that their hit Down under has in fact borrowed from an artist who wrote a song earlier with similar verses and was given no credit. The court battle is for a sum of apparent unpaid royalties. Funny to me that the song was released in 1981, yet this only comes to light now. It's not like the song hasn't been played a million times in every pub, club, and on radio, tv etc. It is practically the unofficial Australian anthem or at least deserves the same status. If you like Down Under, then you should listen to their best of with Overkill, Be good johnny, It's a mistake etc

    This was back in the paper again. The story is, there is a company that claims it owns the rights to the flute piece in the song Downunder. They are after half of all the royalties that were made from this song. They claim the flute piece was stolen from a childrens nursery rhyme called "The kookaburra sits in the old gum tree". This piece was apparently originally written by a school teacher living in Melbourne in the suburb of Toorak. Colin Hay was in court again, defending the claim. I hate to think what the payout could be if Men at work are found liable?

    Why wait after all of these years to file a claim? I thought perhaps the Kookabura song would have been in the public domain after so many years had passed and would be copyright free. I'm sure the royalties they've earned from this song over the past twenty-odd years is quite staggering!
